Done For Your Programs, Challenges and Bundles Terms & Conditions

Please read these terms & conditions of use carefully. By purchasing the FIT CHICKS Academy® Template Bundles, Done for you programs or challenges, Holistic Nutrition & Health Coaches Club Membership and any materials, you agree to abide by these terms & conditions, which will constitute our agreement and program release.

DISCLAIMER

You agree you are 18 years old or older. You alone are responsible for your actions and results in life, fitness, health and business.

When addressing fitness, nutrition or wellness in any of our programs, websites, videos, newsletters, templates or other content, they are for educational purposes only and do not replace, or override the advice your own medical health representative(s).

We do not claim that anything taught in our programs, available on our websites or contained in our videos, newsletters, social media, emails, books or other content, will guarantee fitness, nutrition, wellness or lifestyle treatments or cures.

We make no representations, warranties or guarantees that you will achieve any results from our ideas or content presented in our programs, available on our websites or contained in our videos, newsletters, books, social media, emails, and we offer no professional, legal, medical, psychological or financial advice in connection with same.

You agree you have reviewed your province, state or country laws and regulations when it comes to coaching in fitness, nutrition or wellness prior to purchasing this program. We do not make any guarantees this program will provide you with employment of any kind including starting your own business.

It is your responsibility to ensure any clients, guests, customers or anyone you share information with are aware that it is for their own educational purposes only and it is not medical advice. You agree it is also your responsibility to to get your own legal advice within your area to confirm use of any waiver forms, intake forms or any forms that are required for coaching as well as insurance within your province, state or country laws and regulations

SOME COUNTRIES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY IN CONTRACTS WITH CONSUMERS AND AS A RESULT SOME OF THE TERMS OF THIS SECTION MAY NOT APPLY TO YOU.

This agreement includes this legally binding liability release, waiver, discharge and covenant not to sue (the “Release”), made by you, to (i) LAJQ Chick Enterprises Inc. (ii) to the representatives, employees, agents and contractors of LAJQ Chick Enterprises Inc., and (iii) to the shareholders, officers and directors of LAJQ Chick Enterprises Inc., and their respective heirs, legal representatives, successors and assigns (collectively the “Releasees”).

You fully recognize that there are dangers and risks to which you may be exposed by participating in an educational programs or classes at FIT CHICKS® Academy., and/or on its websites including Fitchicks.ca, Fitchicks.com and FitchicksAcademy.com, which may involve working with body weight exercises, exercise equipment and culinary equipment and tools that may be dangerous. With full understanding of the risks involved and despite this Release, you agree that you are voluntarily choosing to participate in a program or classes operated by LAJQ Chick Enterprises Inc. and you are willing to participate in the activities associated with those endeavors.

In consideration of and in return for the services, access to content and/or use of facilities, and other assistance provided to you in these activities, you agree that you release the Releasees from any and all liability, claims, and actions that may arise from injury or harm to you, including from your death or from damage to your property in connection with these activities.

You understand that this Release covers liability claims and actions caused entirely or in part by any acts or failures to act by the Releasees, including but not limited to negligence, mistake, or failure to supervise.

You further agree to abide by all the rules and regulations promulgated LAJQ Chick Enterprises Inc. while performing these activities.

You recognize that this Release means you are giving up, among other things, rights to sue the Releasees for injuries, damages, or losses you may incur while participating in these activities. You agree that you also understand that this release binds your heirs, executors, administrators, and assigns, as well as yourself.

Limited License Agreement – Holistic Nutrition & Health Coaches Club

These are the licensing terms of the Holistic Nutrition & Health Coaches Club operated by LAJQ Chick Enterprises Inc.

An active membership denotes a current paying member who is provided access to the Holistic Nutrition & Health Coaches Club and its affiliated content.

An inactive membership indicates that the membership has been canceled, expired, or suspended due to failed payment or other circumstances.

You are purchasing one individual monthly or annual membership (no sharing) to use of the FIT CHICKS Academy Holistic Nutrition & Health Coaches Club (each, and collectively, “Product”), granting you access. We make no guarantee about unlimited ongoing access and reserve the right to add or remove content at any time.

Duplicating, sharing, or uploading Product (or any part of a Product) or any published materials from our websites to sharing sites is considered stealing, and we reserve the right to take any and all legal action against such theft as we see fit to the full extent of the law.

The Product, including all related course material and any content, including from our websites, is protected by copyright, trademark, and other intellectual property laws, and as between you and us, is owned by LAJQ Chick Enterprises Inc. or its suppliers or licensors. The Product, related material and content, including from our websites, is licensed to you solely for your individual use while an active member.

As an active member, here is what you are able to do with the Holistic Nutrition & Health Coaches Club:

Use the content with 1:1 clients, group coaching programs, online course, retreats, webinars and presentations
Teach the content to as many people as you want (as a paid product, engagement tool or a lead generation tool)
Use the content in your paid membership site for members use, as a bonus to a paid product or as a free lead magnet to grow your audience
Include the content in ebooks and reports (sold with personal rights only)
Use the content to create tools and training for your team and affiliates
Edit the content with your testimonials, images, additional notes, etc.
Put your own name, logo, and/or website on the resources
Edit the text and/or add your own images
Use the content for social media posts, blog posts,
Resell the content on your website only after rebranding (images of the FIT CHICKS Academy product, product mock ups or marketing materials used by FIT CHICKS Academy can not be used in paid advertising or to promote)

As an active member, here is what you can not do with the Holistic Nutrition & Health Coaches Club:

Sell, give away, resell, grant or pass on private label resell rights or master resell rights using paid advertising
Sell, give away, grant, resell or pass on private label resell rights or master resell rights to the editable files, templates or documents to anyone
Add the content to White Label, PLR, Resell Rights, or Master Resell Rights membership sites or stores
Add the content to free Internet Marketing membership sites, forums, or social media pages/groups
Add the content to article directories without substantial rewriting
Use the original creators name or business name (FIT CHICKS Academy) on the content
Use the content in a way that competes with the original creators services or products
freely publish the entire content on the web except as noted above regarding social media, blog posts
Share this content with anyone for use. It is a single person license. If you know of others who would like to use this product, please direct them to our website or email info@fitchicks.ca

Individuals without an active membership forfeit access to the benefits outlined in the active membership terms above. Inactive members cannot teach, market, integrate, interact with clients, or use the content/material in any manner specified for active members.

You may not use the Product or the materials available in the Product, related course material or the content, including from our websites, in a manner that constitutes an infringement of our rights or that has not been authorized by us.

More specifically, unless explicitly authorized in this agreement or by the owner of the materials, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Product, related course material or the content, including from our websites unless described in this agreement.

If you violate any of the foregoing license terms, your license will immediately terminate and you will cease all use of, and destroy any copies of, the licensed materials.

In addition, certain Products contain additional use and rights terms, which will be applicable to the product in which they are contained.

You agree that you will notify us of any feedback or suggestions relating to the Products, service and content, and related materials; and you hereby grant to LAJQ Chick Enterprises Inc. a nonexclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sub-licenseable, fully paid up and royalty-free right to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, use and commercialize, in any way now known or in the future discovered, any information you provide, directly or indirectly to us, including all feedback or suggestions.

You promise and warrant to only provide us information and content that you have the right to give us, and you will indemnify us in respect of any claims and/or actions if this is not true.

All rights not expressly granted under this agreement are reserved by us and our licensors and suppliers.

Limited License Agreement – Templates, Done For You Program or Challenges, Design Bundles

You are purchasing one individual (no sharing) use or one copy of a FIT CHICKS Academy template, done for you program or challenge or other design bundle (each, and collectively, “Product”), granting you access We make no guarantee about unlimited ongoing access and reserve the right to add or remove content at any time.

What you are able to do with FIT CHICKS Academy templates, done for you programs, challenges or bundles:

Use the content with 1:1 clients, group coaching programs, online course, retreats, webinars and presentations

REFUND POLICY

There is a 7 day refund window from the date and time of purchase. To obtain a refund, please email info@fitchicks.ca within the timeframe. No refunds will be issued after this time.

Please note it is our strict policy that all communication internal and external be respectful towards all members of our community and that any foul language, slander or comments made to create a negative experience for anyone in our community will not be tolerated
